The Trump Administration Requests Supreme Court Clearance for Military Reserve Personnel in the State of Illinois

On the end of the week, the government filed an emergency request to the federal top court, asking for clearance to station national guard troops to Chicago and surrounding areas.

This step is part of a broader push to expand the homefront role of the military in several urban centers under Democratic control.

Legal Battle Over Military Presence

In an emergency filing, the US Department of Justice asked the court to set aside a previous judicial decision that had halted the stationing of hundreds of national guard personnel to the Chicago area.

The federal judge had raised doubts about the administration's reasoning for activating the guard, doubting its rationale in considering regional circumstances.

A appellate court supported the previous order on Thursday, maintaining the activation on hold while the judicial dispute continues.

Government's Arguments

The solicitor general, speaking on behalf of the administration, wrote in the new filing that federal agents have often been “threatened and attacked” in the city of Chicago and the suburb of Broadview.

This site is home to an ICE holding center.

The commander-in-chief has previously sent national guard personnel to Chicago and Portland, following previous activations to Los Angeles, California, the city of Memphis, and the nation's capital.

The president has stated that military intervention is necessary to reduce protests and support border control.

Political Resistance

Opposition leaders have strongly opposed the move, saying that the administration's assertions are greatly exaggerated and driven by politics.

They allege the administration of abusing his executive power to retaliate against critics.

The judiciary have also expressed doubt about the government's portrayal of ongoing incidents.

Local leaders state that protests over immigration enforcement have been largely limited and non-violent, challenging the former president's characterization of “battlefield” situations.

Statutory Grounds

At the heart of the dispute is the administration's application of a federal statute permitting the executive branch to federalize the national guard only in instances of insurrection or when “incapable with the federal troops to carry out the statutes of the nation”.

The government insists that the troops are required to protect US facilities and personnel from protesters.

In recent weeks, the White House took control of several hundred personnel of the state guard of Illinois and directed more Texas-based personnel into the region.

As local leaders denounced the move, the president intensified his language, urging the apprehension of the city's leader and the governor of Illinois, both Democrats, accusing them of failing to secure immigration officers.

State authorities and Chicago together took legal action against the White House to block the deployment.

On October 9, the presiding federal judge, nominated by President Biden, issued a preliminary order stopping the command.

On-the-Ground Incidents

Simultaneously in the Chicago area, at least eleven people were taken into custody outside the Broadview Ice detention center following intense clashes between local police and activists.
